Statement Regarding Legal Actions Related to the Marjory Stoneman Douglas Tragedy

April 27, 2018,

Broward County Public Schools would like to clarify a portion of a statement made earlier today regarding the Stoneman Douglas Victims’ Fund administered by the Broward Education Foundation, an independent 501c3 nonprofit organization.  We would like to make clear that neither the school district nor Superintendent Robert Runcie are affiliated with the Fund or the volunteer steering committee that was appointed to raise additional money and oversee a disbursement plan. The Foundation and committee are totally independent of the school district. The money in this charitable fund was generously donated by businesses and individuals from around the globe and 100 percent of it will be given to the victims as unrestricted gifts later this summer.

“Across our community, our hearts remain with Marjory Stoneman Douglas High School and all of those impacted by the February 14, 2018, tragedy. The District is not placing a “value” or setting liability limits regarding the tragedy at Marjory Stoneman Douglas High School. Rather, the Superintendent supports the independent work of the Broward Education Foundation and the steering committee created to raise funds for the Marjory Stoneman Douglas victims’ families, survivors and those impacted by the tragedy but is not affiliated with the fund in any manner. With regard to legal actions, the District is guided by state law (F.S. Sec. 768.28) – and this law sets sovereign immunity caps for legal actions against all public agencies, including the School Board. This law also incorporates the ability of victims’ families and survivors to make claims to the legislature beyond the sovereign immunity caps. The District remains committed to providing support and resources for all those impacted by this tragedy.”

Broward County School Board Votes to Not Participate in the State’s Guardian Program

On Tuesday, April 10, 2018, the School Board of Broward County, Florida approved an agenda item that authorizes Superintendent Robert W. Runcie to communicate the intent of the School Board regarding the Coach Aaron Feis Guardian Program with appropriate outlets, including Florida’s Governor, the Commissioner of Education, the State Board of Education, and the State Legislature.

It is the intent of the School Board to not participate in this program.

Following the tragedy at Marjory Stoneman Douglas High School, the legislature passed Senate Bill 7026. This legislation includes the Coach Aaron Feis Guardian Program provision, Florida Statute 30.15(1)(k), to allow certain District employees to be armed.

It is the position of the School Board that the funding allocated for the Coach Aaron Feis Guardian Program should be redirected into the Safe Schools Allocation in order to provide additional funding for School Resource Officers.
